Brexit brings up many questions for EU citizens living in the UK. At Elite Law Solicitors, we understand that this is a confusing time and you have many questions. Let us help guide you through the immigration process and secure the future of you and your family within the UK.

Settled status

Settled status applies to EU citizens living in the UK for more than five years. The cut off point for making an application under the EUSS was June 30, 2021.

Who can apply?

If you are an EU citizen who has lived in the UK consecutively for five years or more, you have the right to apply for settled status. This means that you would be able to remain in the UK as a permanent resident. If you are a citizen of Norway, Iceland, Liechtenstein, or Switzerland, contact Elite Law Solicitors to discuss your options for remaining in the UK as a permanent resident

What will I be able to do after I have achieved settled status?

  • Work in the UK
  • Use the NHS service
  • Study
  • Access public funds
  • Travel in and out of the UK.

Does receiving settled status make me a British national?

Unfortunately, receiving settled status does not automatically make you a British national. However, 12 months after receiving this, you may apply for British nationality.

Pre-settled status

Pre-settled status refers to a EU citizens who have been living in the UK for less than five years on the date of December 31, 2020. If you have not resided in the UK for five years consecutively, you will be granted what is known as pre-settled status. With this, you will be allowed to live in Great Britain until you reach five years. Upon reaching five years, you may apply to change your status to a settled status at no additional cost.

What happens after you are given pre-settled status and eventually reach the five-year UK residence requirement?

As an individual with a pre-settled status living in the UK, you can apply for settled status after you have reached five consecutive years in the UK. It is very critical that you apply for your pre-settled status in order to remain eligible for settled status once you have met the five-year requirement.
