What is a UK Spouse Visa?

Spouse Visas (sometimes referred to as Family Visas) allow the husband, wife, civil partner, or unmarried partner of a British citizen or someone settled in the UK to join them and live together in the UK. Key features of this visa include:

  • Permission to live and work in the UK.
  • An initial grant of 2 years and 9 months if applying from outside the UK, or 2 years and 6 months if switching from within the UK.
  • A pathway to settlement (Indefinite Leave to Remain, or ILR) after 5 years.

Who can apply for a UK Spouse Visa?

You may apply for a Spouse Visa if you are the spouse, civil partner, or unmarried partner of:

  • A British citizen
  • A person settled in the UK (with Indefinite Leave to Remain or settled status under the EU Settlement Scheme)
  • A person with refugee status or humanitarian protection

If your partner is in the UK on a temporary visa (e.g. work visa, student visa), you cannot apply for a Spouse Visa.

How long do UK Spouse Visas last?

UK Spouse Visas have two different durations that depend on whether you applied from inside or outside of the UK. If you have applied from outside of the UK, then your Spouse Visa will last for 2 years and 9 months. If applying within the UK, it will last for 2 years and 6 months.

The Spouse Visa can then be extended for a further 2 years and 6 months, bringing the total to 5 years, after which the applicant may apply for Spouse Visa Indefinite Leave to Remain (ILR).

UK Spouse Visa requirements (2026)

The Home Office places a strong emphasis on the genuineness of the relationship when applying for Spouse Visas. Applicants must prove that the relationship (marriage or civil partnership) is legally recognised in the UK. It must also be a genuine relationship that is subsisting and not a marriage of convenience. It is also important that you can demonstrate that you both intend to live together permanently in the UK.

To do all of this, evidence is important. This may include:

  • Marriage or civil partnership certificates.
  • Photographs together over time.
  • Correspondence, messages, or travel records showing contact and visits.
  • Joint financial commitments (such as a tenancy agreement or bank account).

Unmarried partners must demonstrate that they have been in a relationship akin to marriage for at least two years.

Financial requirements for a Spouse Visa

One of the most challenging aspects of the Spouse Visa application is meeting the minimum income requirement.

The UK-based partner (the “sponsor”) must show a minimum gross annual income of £29,000 per year. This requirement increases if dependent children are included in the application. To meet this financial requirement, you can use:

  • Employment income from the sponsor’s salary or self-employment.
  • Savings can be used if the sponsor does not meet the income requirement. Savings of over £88,500 can be used to meet the threshold.
  • A combination of income and savings is permitted in some circumstances.
  • Other income sources, such as pensions, rental income, or dividends, may also count.

If the UK-based partner is in receipt of certain benefits (such as Disability Living Allowance or Carer’s Allowance), the strict income threshold may not apply. However, “adequate maintenance” must be shown instead.

Accommodation requirements for a Spouse Visa

Couples must demonstrate that they have suitable accommodation in the UK that is not overcrowded and does not breach public health regulations. You will need to show some evidence of your accommodation in the form of tenancy agreements, mortgage statements or letters from landlords confirming permission for you to live there.

English language requirement for a Spouse Visa

Unless exempt, applicants must prove they can speak and understand English at CEFR level A1 or above. You can meet this requirement by:

  • Passing an approved English language test
  • Having an academic qualification taught in English and recognised by ECCTIS
  • Being a national of a majority English-speaking country (such as the USA, Canada, or Australia)

Exemptions apply for applicants aged under 18 or over 65, or for those with medical conditions preventing them from meeting the requirement.

How to apply for a UK Spouse Visa

Applying for a UK Spouse Visa is a detailed process, and many applications are refused because of incomplete information or insufficient supporting evidence. To maximise your chances of success, it helps to understand each stage clearly.

At Elite Law Solicitors, we have helped many couples successfully apply for Spouse Visas using a tried-and-tested process. Below, we have broken down the steps to this process for you:

Step 1: Complete the Spouse Visa online application form

All Spouse Visa applications start online through the UK Government’s official website. You will need to:

  • Select “Family visa” and then choose the option for a spouse, civil partner or unmarried partner.
  • Provide detailed information about yourself and your partner, including personal details, immigration history, and travel history.
  • Answer questions about your relationship, finances, accommodation, and whether you have children.

Take your time when completing the form. Even small inconsistencies, for example, different dates of marriage or mismatched details between the form and your documents, can raise doubts and cause delays or refusals.

Step 2: Pay the Spouse Visa application fees

Spouse Visa applications are not submitted until the fees are paid. Spouse Visa fees will vary depending on who you are joining and how you apply.

  • Spouse Visa cost UK when joining your partner, parent or child: £1,938 (or £1,321 if applying within the UK)
  • Spouse Visa cost UK for each dependant included in the application: £1,938 per person (£1,321 if applying within the UK)

You may also have to pay a healthcare surcharge during the application, which will give you access to the NHS for free. For each adult (18+), it will cost:

  • £2587.50 if you intend to stay for 2 years and 6 months
  • £3,105 if you intend to stay for 2 years and 9 months
  • £5,175 if you intend to stay for 5 years

The price is different for children under 18. For each child, the healthcare surcharge is:

  • £1,940 if you intend to stay for 2 years and 6 months
  • £2,328 if you intend to stay for 2 years and 9 months
  • £3,880 if you intend to stay for 5 years

This means the total Spouse Visa cost UK is often several thousand pounds once fees are added together.

Step 3: Book and attend a biometrics appointment

After submitting the Spouse Visas application form and paying the fees, you must book an appointment at a Visa Application Centre (VAC) if applying from abroad, or a UKVCAS service point if applying from within the UK. At this appointment, you will have to:

  • Provide your fingerprints and a digital photograph (biometric information).
  • Have your supporting documents scanned and uploaded (or submit them online in advance, depending on the service).
  • In some centres, you may also be asked additional questions.

Optional services may be available, such as priority processing, document checking, or courier return of documents.

Step 4: Gather and submit supporting documents for your Spouse Visa application

This is one of the most important stages, as the Home Office makes its decision largely based on the evidence you provide. Take your time at this stage, as it can be quite complicated. Always provide originals or certified copies where possible, and ensure documents are dated, consistent, and properly labelled. Typical documents include:

  • Proof of relationship: This may include a marriage or civil partnership certificate, photographs showing your relationship over time or joint financial commitments like a tenancy.
  • Proof of finances: This should include things like payslips, bank statements, tax returns and savings account statements. It can also be helpful to include employment contracts.
  • Proof of accommodation: You need to demonstrate that you have suitable accommodation in the UK. Evidence of this may include mortgage statements, a tenancy agreement or a property inspection report.
  • Proof of English language ability: You may need to show you have English language proficiency with an approved English language test pass certificate. Alternatively, a university degree taught in English or evidence of nationality from an English-speaking country can act as sufficient evidence for this.
  • Other documents: Copies of a valid passport, children’s birth certificates and any required translations for documents should be included.

Step 5: Upload documents online or at the appointment

Most VACs and UKVCAS centres allow you to upload documents online before your appointment, but you can also bring them with you to be scanned.

It is good practice to prepare a clear bundle of documents organised into sections (relationship, finances, accommodation, etc.). This makes it easier for the caseworker to review.

Step 6: Attend an interview (if required)

Not every Spouse Visa applicant is interviewed, but in some cases, the Home Office may request one to test the genuineness of the relationship. Possible interview questions include:

  • How and when did you meet your partner?
  • Where was the wedding held and who attended?
  • What are your partner’s job and daily routine?
  • Where do you plan to live together in the UK?

Being consistent and honest is very important during the Spouse Visa application process. Any contradictions between your answers and the supporting documents can harm your application.

Step 7: Wait for a decision

The Spouse Visa UK processing time depends on whether you are applying from inside or outside the UK. For applications outside of the UK, you should expect to hear a decision in around 12 weeks. For all applications inside the UK, it is a little shorter, about 8 weeks. Once a decision has been made, you will be notified by email or text.

Priority services are sometimes available for an additional cost. A standard priority service allows you to receive a decision in 5 working days. There is also an option for super priority service, which gives you a decision within 24 hours. It is a costly and limited approach, though.

Step 8: Collect your Spouse Visa and travel to the UK

If your Spouse Visa application is successful, you will receive either:

  • A vignette (sticker) in your passport (if applying from outside the UK), valid for 30 days to travel. After arriving in the UK, you must collect your Biometric Residence Permit (BRP) within 10 days.
  • A digital status (if applying from within the UK), viewable online and shareable with employers or landlords.

If your Spouse Visa application refused, the Home Office will issue a refusal letter explaining the reasons. Depending on the grounds, you may be able to appeal or reapply with stronger evidence.
